Business&Law » Warsaw meetings on arbitration – the new initiative of the European Centre of Arbitration

At the turn of February and March 2014, the European Centre of Arbitration, young and vigorously growing association, organised a series of lectures and workshops given by leading Polish practitioners in the field of international arbitration. These academic events, known as  the “Arbitration Academy” were dedicated to law students and young practitioners in the domain of arbitration. The events were held at the Faculty of Law and Administration (University of Warsaw) in Warsaw. The series of lectures and workshops was devoted to international commercial and investment arbitration. Among the speakers there were many persons that are well-known in the field of arbitration in Poland. These were Marcin Asłanowicz, Ph.D. (litigation and arbitration practice of Baker McKenzie), Marcin Dziurda, Ph.D. (Former Head of the General Attorney of the Treasure), Maciej Jamka (litigation and arbitration practice of K&L Gates) Dariusz Skuza (litigation and arbitration practice of Sołtysiński Kawecki & Szlęzak) and Rafał Stroiński, Ph.D. (capital markets and M&A practice of Jankowski & Stroiński JSLegal). The opening lecture was given by Rafał Stroiński and concerned amicable shareholders agreements. Mr Stroiński was wondering how arbitration agreement can be applied in the commercial law perspective. Mr Stroiński, highly experienced in commercial disputes, raised many important issues regarding the structure and wording of the shareholders agreements. The purpose of the second lecture, delivered by Dariusz Skuza, was to discuss the issue, whether arbitration proceedings are more efficient than litigation. In order to analyse this issue – three fundamental factors were compared and scrutinized in details, i.e. time, costs and the result of the proceedings. During the third speech, given by Marcin Asłanowicz, participants got familiarised with activities of the International Court of Arbitration associated with International Chamber of Commerce (ICC) in Paris and learned some practical techniques useful to the attorneys representing clients before this Court. The fourth meeting chaired by Marcin Dziurda was devoted to international investment arbitration and disputes between states and investors. Due to Mr Dziurda wide experience in the field of state’s representation Mr Dziurda tackled the key elements of arbitration proceeding particularly important to this party of the dispute. In turn, the investor’s perspective was presented by the last lecturer, Maciej Jamka who acted on behalf of the major international companies in several arbitration proceedings and served as arbitrator. Thanks to the outstanding guests and devoted participants of the Arbitration Academy, it turned out to be a big success. Taking part in this course was a marvellous opportunity to broaden one’s knowledge on arbitration and international law.   Jagna Mucha is Ph.D. candidate at the Institute of International Law, the Faculty of Law and Administration of the University of Warsaw. She prepares the dissertation regarding alternative dispute resolution in the light of European law under the academic supervision of Prof. dr hab. Robert Grzeszczak. In her academic research Jagna is particularily interested in international commercial arbitration and legal mediation. She ran her research in this field in a number of academic centers in France, Germany and the Netherlands being a grant holder of several scholarships. She was granted the scholarship by International Academy for Arbitration Law in Paris, Academy for International Law in the Hague and Deutscher Akademicher Austausch Dienst for doctoral students in Munich. She is one of the co-founders of the European Center of Arbitration in Warsaw.
